Toledo – One of two men accused of taking $4,000 from an elderly woman in a tree-trimming scam was convicted yesterday in Lucas County Common Pleas Court.
David S. Broadway, 28, pleaded no contest to theft from the elderly. He was found guilty by Judge Frederick McDonald, who scheduled sentencing for March 6. His co-defendant, Thomas Reinhart, 21, faces trial Feb. 6.
Police said the victim, Lillian Cook, 88, agreed Oct. 13 to have the defendants cut a large tree branch hanging above her house in the 3000 block of Gracewood Road. Instead, several limbs were cut from an ash tree near the street that the city had marked for removal.
After realizing she was wrongly charged, she tried to stop payment on the check she gave to the men for the work.
However, the check was cashed at a Toledo bank soon after the men left her home.
