2013 data from the Bureau of Labor Statistics shows that the average national pay for a landscaping worker is $12.65/hour. Changes in wage regulations are being proposed or have already taken place that demand your attention because they can affect your bottom line.

Working Overtime
Besides hourly employees, salaried employees making less than $455/week are entitled to overtime. This spring the White House instructed the Department of Labor to "update regulations regarding who qualifies for overtime protection" – essentially raising the minimum weekly salary so that more salaried employees qualify for overtime.

Calculating H-2B Wages
The Office of Foreign Labor and Certification just announced the availability of Occupational Employment Statistic (OES) wage information for landscaping and groundskeeping workers, for July 2014 - June 2015.

H-2B Wages Are Based on the Highest of:

  • OES wage information
  • Any current collective bargaining agreement
  • Rate established by the Davis-Bacon Act or the McNamara O'Hara Service Contract Act
Example - In Muncie, Ind., the average OES hourly wage for green industry workers is $12.06. However, H-2B compact loader operators would receive at least $22.97 based on a 2013 union agreement. A brick mason would receive at least $14.00 based on the Davis-Bacon Act.

Increasing the Minimum

States with newly enacted minimum hourly rates:

Massachusetts - $11.00 by 2017
Vermont - $10.50 by 2018
Maryland - $10.10 by 2017
Connecticut - $10.10 by 2017
Hawaii - $10.10 by 2018
California - $10.00 by 2016
Minnesota - $9.50 by 2016
Michigan - $9.25 by 2018

Municipalities may set their own hourly minimum wage:
Seattle - $15.00 by 2021
Washington D.C. - $11.50 by 2016
San Francisco - $10.74 Presently

Proposed municipal rates:
San Francisco - $15.00 by 2018
Chicago - $13.00 by 2018

According to proponents of a ballot measure to raise the minimum wage in Alaska, minimum wage legislation can be repealed - ballot measures that pass are more binding. Make known your preference for ballot measures, legislation or neither.

The U.S. Department of Labor, Wage and Hour Division proposed to increase the minimum wage that contractors pay to workers on covered federal contracts to $10.10/hr. beginning 1/1/15.
