Virginia Considers Fertilizer Legislation

Virginia – Two bills of concern to the green industry have come before Virginia?EUR??,,????'?????<

H.B. 2663 would prohibit commercial providers of lawn care services from broadly applying pesticides and fertilizers onto impervious surfaces such as streets and driveways.

While industry leaders agree that improper application of fertilizers is an issue that must be addressed, they cited the following problems with the bill:

  • It is unenforceable.
  • It makes it illegal to apply labeled weed control products to gravel driveways.
  • It makes it illegal to apply ice-melt.
  • It only targets one segment of persons who apply pesticides and fertilizers. It does not target homeowners and goverment employees.
  • It makes it illegal to apply labeled weed control products to curbs, cracks and crevices.
  • It adds a whole new level of bureaucracy by giving oversight to an agency other than VDACS, an agency already empowered with fertilizer and pesticide regulation.

The second bill, S.B. 1061, focues on local regulation of fertilizer. It prohibits localities from regulating the registration, packaging, labeling, sale, storage, distribution, use or application of fertilizers more stringently than the U.S. Environmental Protection Agency or the Department of Environmental Quality.

This is a bill the VTC and other associations are hoping will pass, Tracy said. It ?EUR??,,????'?????<
