California is pondering new emissions rules that would force expensive upgrades on backhoes, loaders, tractors and other diesel-burning, off-road construction equipment. As with other legislation, of course, what starts in California could spread to other states.
But the fate of the sweeping rule that would require construction equipment to have their engines retrofitted with filters or replaced entirely will have to wait another two months.
The California Air Resources Board on May 25 delayed a vote on the rule until July 26. The board received a significant amount of testimony and had a packed crowd at its meeting in San Diego, and decided to provide more time for public input, a spokeswoman said.
Board staff members say the rule would reduce harmful toxic soot from construction equipment engines by 70 percent, dramatically improving public health.
The construction industry says the rule?EUR??,,????'?????<????????????EUR??,,??s retroactive nature ?EUR??,,????'?????<??????????? all machinery, not just new equipment, is affected ?EUR??,,????'?????<??????????? would be too costly and could delay road projects. It is seeking five extra years to complete the rule?EUR??,,????'?????<????????????EUR??,,??s requirements, which as proposed now, would begin in 2010 and end in 2020.
California has the state?EUR??,,????'?????<????????????EUR??,,??s strictest emissions rules. In March, Husqvarna Outdoor Products paid the Air Resources Board $281,000 for shipping unapproved string trimmers to local Sears stores. And this month, Southern California?EUR??,,????'?????<????????????EUR??,,??s air-quality agency is debating a measure that would ban wood fireplaces in new homes.
A coalition of contractors?EUR??,,????'?????<????????????EUR??,,?? groups called the Construction Industry Air Quality Coalition (CIAQC) opposes the new legislation for diesel construction equipment.
An Air Resources Board report points out negative impacts if the new rules pass, CIAQC says.
?EUR??,,????'?????<????????The regulation is expected to increase the cost of construction, mined materials, and other services performed by off-road vehicles in the state,?EUR??,,????'?????<???????? the report says.
