As you know, Dixon Industries, Inc., (“Dixon”) is one of the nation’s leading manufacturers and distributors of lawnmowers. In addition, as you may be aware, Dixon is the owner of federal registration No. 1,024,513 for the well-known ZTR mark, which it uses in connection with lawnmowers. Dixon’s right to use its registered ZTR mark has become incontestable. As a result, Dixon’s ZTR registration is conclusive evidence of Dixon’s exclusive ownership of and right to use the ZTR mark in commerce.
