New Stormwater Rules Adopted




Debris such as lawn clippings or pine straw is often blown into streets, storm drains, or ditches, which contributes to flooding when it rains resulting in a $250 fine. Polluting substances such as pesticides entering the drains carries a $10,000 fine.

New stormwater regulations are set to take place in Wilmington, North Carolina. The new ordinances bring the city's regulations in line with new state regulations. They outline requirements that could impact landscape contractors and maintenance crews for development, yard debris and the illegal discharge of polluting substances into the storm drainage system.

Highlights of the changes include: Anyone who causes yard waste or other debris to enter a storm drain, drainage ditch, or other part of the drainage system could face a fine of $250. Anyone found responsible for causing a polluting substance to enter the drainage system could face fines of up to $10,000.

On the property owners side, pet owners will be required to carry a clean-up device for pet waste, and clean up after their pet when on public property or they could face a fine of $250. In addition, property owners need to keep drains on their property clear and free from obstructions so water can flow freely or they could face a fine of $250.

Developers in the city will no longer be required to obtain a stormwater permit from the state for new projects, but will need only a city permit.There will be reduced requirements for redevelopment in priority areas to encourage redevelopment projects in those areas.
