After having to deal with the aftermath of two houses that were built in the wrong place on a lot, the village has put its foot down.
A new ordinance approved by the Village Board requires general contractors to certify to the village’s zoning enforcing officer that a building adheres to all requirements before the village issues a certificate of occupancy.
The ordinance removes the responsibility of rectifying a building problem from the property owner, as specified in a previous ordinance, and transfers it to the contractor. A contractor who violates the dictates of a building permit, site plan or village ordinance can face litigation and a fine of $50 to $750 per day.
While neighboring communities Washington, East Peoria and Pekin do not have a similar ordinance to Morton, each has a strategy for assuring that a contractor follows the rules. None reported a wrong location problem like Morton experienced.
