Mobile, Ala. Threatened with Stormwater Fines





"Muddy Water Watch" was developed by Mobile Baykeeper, in conjunction with the Alabama Stormwater Partnership, as a statewide education program using volunteers to reduce stormwater runoff pollution.

The Alabama Department of Environmental Management (ADEM) has asked a Mobile, Alabama Circuit Court judge to assess up to $475,000 in fines against the city for failing to meet stormwater benchmarks the city and the ADEM agreed upon to ensure compliance with the Clean Water Act's standards for governing municipal drainage systems and outflows into waterways. https://blog.al.com/live/2013/05/adem_seeks_475000_in_fines_fro.html. ADEM asserts the city did not complete several tasks by a March 30 deadline.

Meanwhile, on April 30, 2013, after months of debate between the city council and the office of Mayor Sam Jones, the council vote 5-2 in favor of hiring a stormwater consultant (The Mobile Group) to meet the ADEM's stormwater requirements by this fall. City council approved the $498,420 contract only after an agreement was reached between Mayor Jones and City Councilman John Williams that the mayor would report to the council about the performance of The Mobile Group.

Mayor Jones told the local media that the delays in approving the stormwater consultant will make it difficult for the city to make up the work that was not done by the March deadline, plus the other work necessary to meet the upcoming fall deadline.

According to Mobile Baykeeper https://mobilebaykeeper.org, an advocate for stormwater regulatory and policy reform, the Mobile Bay watershed, which encompasses the state's largest urban centers, bears the brunt of stormwater runoff. Runoff in the watershed challenges waterway health, water supply and aquatic habitat. Sediment and nutrient pollution, erosion and stream and riverbank collapse, flooding, loss of wildlife, degradation of waterways valued for recreation, and reduction of drinking water supplies are among the challenges. Mobile Baykeeper's goal is to reduce the impacts of construction, municipal and industrial stormwater pollution in the Mobile Bay watershed.
