Landscaper is Fired, Sues Town

A lawyer for a New Hampshire landscaping company fired by the town last week says he will sue the town for breach of contract.

On September 2, selectmen in the town of Pelham voted to terminate Santastic Landscaping, but they would not say why. The vote was 4-0 to terminate the services of the Pelham company, which had been doing work for the town and school district for the past year and a half, Town Administrator Thomas Gaydos said.

He said he couldn’t discuss the reasons for the firing because it was discussed by selectmen in non-public session Aug. 19.

Richard Shaheen, an attorney for Brian Santos of Santastic Landscaping, said town officials never disclosed why they were terminating his services. The company was hired for three years in 2007.

Shaheen said Santos wanted the matter to be discussed publicly at a selectmen’s meeting, and was told it would be. But a public discussion never took place. Shaheen said there were people prepared to speak in favor of Santastic, including the president of the Pelham Little League, but they were never given the opportunity.

Peter Solomon, an attorney for the town, said he sent a letter in advance to Shaheen to inform him the board would discuss the matter in nonpublic session and take a vote in public session. But he said Shaheen never responded to his letter to ask for the matter to be discussed publicly.

Pelham selectmen Vice Chairman Robert Haverty said his only comment was that the board discussed the matter in nonpublic session and decided to take a public vote to terminate the company’s services.

Shaheen acknowledged there were some “performance-based complaints” against his client, all of which had been addressed. These included complaints about weeds and delays in mowing ball fields, which were due to the unusually rainy weather this summer, he said.
