H2B Cap Hit for Half 2009

As of July 29, 2008 the USCIS will no longer be accepting petitions for H-2B workers requesting employment start dates prior to April 1, 2009.


The U.S. Citizenship and Immigration Services (USCIS) announced today that it has received a sufficient number of petitions to reach the congressionally mandated H-2B cap (33,000) for the first six months of the Fiscal Year 2009 (FY2009).

Please Note: Those petitions received on July 29, 2008 will be subject to a computer-generated random selection process to see how many are needed to meet the cap. USCIS will reject, and return the fee, for all cap-subject petitions not randomly selected.

USCIS will continue to process petitions filed July 29, 2008, or after, that seek to:

?EUR??,,????'????Extend the stay of a current H-2B worker in the United States;

?EUR??,,????'????Change the terms of employment for current H-2B workers to extend their stay; or

?EUR??,,????'????Allow current H-2B workers to change or add employers and extend their stay.

Congress’s inability to renew the returning worker exemption has caused the cap to be met earlier than ever before.
