H-2B Rule Has Been Blocked




PLANET Attorney Richard Lehr noted that Judge Rogers relied extensively on the sworn statement from PLANET CEO Sabeena Hickman, detailing the serious harm the DOL?EUR??,,????'?????<

The Professional Landcare Network (PLANET) and other parties affected by the H-2B rule recently filed two lawsuits in the Northern District of Florida against the Department of Labor (DOL).

Many other affected associations and groups, such as the Golf Course Superintendents Association of America (GCSAA) and The American Horse Council (AHC) have been urging their members to take action.

The GCSAA posted on their website last week:
''Please ask your U.S. Senators TODAY to co-sponsor and help push for passage of S.J.R. 38 or thank them for their current co-sponsorship. Enter your Zip Code in the Take Action Now box to take action on this important golf facility issue! A template letter is available for your use.''

The efforts of these groups have paid off, as PLANET announced last night that the U.S. District Court Northern District of Florida Pensacola Division, Judge M. Casey Rodgers, has granted an injunction. This will prevent DOL from implementing the program rule until September 30th. Although the ruling was issued in Florida, the decision applies nationwide. The ruling will also impact the DOL?EUR??,,????'?????<

Tom Delaney, PLANET Director of Government Affairs said, ''We expect the Department of Labor to appeal the decision, but any legal challenge will most likely take months to play out before a final decision is issued. In the meantime, the H-2B program will continue to be a viable program for landscape contractors across the country.''
