WASHINGTON ?EUR??,,????'??+ House Minority Leader Richard Gephardt (D-MO) recently unveiled his Earned Legalization and Family Unification Act. H.R. 5600 puts forth a short-term solution to the current immigration crisis gripping America: earned adjustment status. According to the American Nursery and Landscape Association, the proposal?EUR??,,????'???s terms are more akin to an amnesty program than a true earned adjustment of status ?EUR??,,????'??+ In contrast to ANLA?EUR??,,????'???s version of earned adjustment that includes a requirement to work in the green industry for several years after status adjustment, H.R. 5600 does not. In unveiling the bill, Gephardt stated that guest worker reform was an essential element of any comprehensive labor and immigration policy change; although, H.R. 5600 does not address guest worker reform. However, Gephardt suggested guest worker reform should be based on union and not employer issues. For instance, wages would be determined based on ?EUR??,,????'??union contracts and benefits.?EUR??,,????'?? In addition to guest workers having the right to organize, Gephardt suggests reforms mandate ?EUR??,,????'??equitable labor protections for foreign and U.S. workers.?EUR??,,????'?? There were no mentions of any mechanisms designed to ease the burdens on employers through streamlining the certification process.
