Perverse Incentives in Real Estate transactions: A cautionary report

The Industry Myths That Refuse to Die

In drainage and waterproofing, bad ideas don't disappear-they get repeated, repackaged, and resold.
• "Water will find its way anyway." (Usually said right before someone avoids fixing grading.)
• "A drain here should take care of it." (Without calculating volume, slope,
or discharge.)
• "We've always done it this way." (Often true-and often the problem.)
These phrases persist because they lower the immediate burden of doing things correctly. They also happen to align perfectly with minimizing effort while maximizing short-term profit.
Water, unfortunately, does not respond to optimism or tradition. It responds to physics.

Contractor Mistakes: Predictable, Repeatable, Preventable
Most drainage failures are not mysterious-they are patterned.
• Installing perforated pipe without proper gravel or fabric (guaranteeing clogging).
• Ignoring slope verification
(creating underground water storage instead of movement).
• Treating roof runoff as an afterthought rather than a primary water source. "
• Watershed calculations disregard.
• Failing to design a proper discharge point (sending water to "somewhere over there").
These are not edge cases. They are routine oversights, often driven by time pressure, cost-cutting, or lack of supervision.
The uncomfortable truth: many systems fail exactly as they were built to.

Advanced Systems: Where Precision Actually Matters
As complexity increases-hillsides, retaining walls, hydrostatic pressure-the margin for error disappears.
• Hillside drainage requires interception, not just redirection. Water moving downhill must be captured before it builds momentum and pressure.
• Retaining walls demand layered systems: backdrain, gravel, fabric, and weep relief. Miss one, and the wall becomes a dam.

• Hydrostatic pressure control is not solved with coatings alone. Without pressure relief, water simply waits, builds, and finds another path.
In these environments, drainage is no longer a feature-it is structural.

The Real Estate Layer: Where Incentives Get Complicated
Water damage doesn't just affect structures-it distorts decisions.
When a property shows signs of moisture intrusion, several competing incentives emerge:
• Sellers are motivated to minimize perceived severity.
• Buyers are often unequipped to evaluate drainage systems beyond surface appearance.
• Inspectors may identify symptoms without diagnosing root causes.
• Contractors may propose partial fixes aligned with budget constraints rather than full solutions.
The result is a fragmented understanding of risk.
In many transactions, what is being sold is not just a home-but a narrative:
• "It only happened once."
• "It's been fixed."
• "It's typical for the area."
Sometimes these statements are technically true. They are also frequently incomplete.

Perverse Incentives and the Growth of Fear
Water damage creates a unique feedback loop.
• A problem is underestimated
• A partial fix is applied
• The issue returns
• Costs escalate
• Trust erodes
• Fear increases
That fear becomes economically significant. It influences negotiations, pricing, disclosures, and decision-making.
In some cases, fear benefits certain participants:
• Repeat repairs generate additional work.
• Urgency reduces scrutiny.
• Confusion allows vague solutions to persist.
Meanwhile, homeowners are left navigating uncertainty, often without a clear framework for evaluating what is real, what is fixed, and what is simply hidden.

What Actually Restores Confidence
Clarity-not reassurance-is what resolves fear.
• A system that visibly controls water from source to discharge
• Documentation of design, materials,
and installation
• Verification through testing and performance over time.
Confidence comes from evidence, not statements.
When drainage is done correctly, it becomes unremarkable. No recurring issues. No seasonal surprises. No need for explanation.
Just absence of failure-which, in this field, is the strongest possible result.

Closing Observation: Water Is Honest
Water does not negotiate, misrepresent, or conceal intent. It follows gravity, accumulates with volume, and exploits weakness with consistency.
The same cannot always be said for the systems-and decisions-built around it.
Understanding that difference is what separates temporary fixes from permanent protection.
