Dow AgroSciences announced that it plans to notify the U.S. EPA of its intention to cancel non-agricultural uses and registrations for chlorpyrifos, marketed under the trade names Dursban, Empire and Lorsban along with alternate brand names Tenure and Lentrek. Non-agricultural use include pest control in such use sites as homes, lawns, golf courses, road medians, industrial plant sites as well as indoor and outdoor residential and commercial pest control, or any place where children may be exposed. In 1995, Dow was fined $732,000 for not sending the EPA reports it had received on 249 Dursban poisoning incidents. In 2003, Dow agreed to pay $2 million – the largest penalty ever in a pesticide case – to the state of New York, in response to a lawsuit filed by the Attorney General to end Dow’s illegal advertising of Dursban as “safe.?EUR??,,????'?? Dow continues to market Dursban for home use in developing countries. In India, Dow claims Dursban is safe for people, and its sales literature claimed Dursban has “an established record of safety regarding humans and pets.” In August of 2007, Dow’s Indian offices were raided by Indian authorities for allegedly bribing officials to allow chlorpyrifos to be sold in the country. According to EPA, there will be no “stop use” date, and existing stocks of the end-use products listed above can be used, consistent with their package labels, until stocks are depleted. Existing stocks of these products in Dow AgroSciences warehouses may be sold by Dow AgroSciences until inventory is depleted or for 12 months, whichever occurs first. Inventory of the products listed above in the hands of distributors, retailers, and end users may be sold and used as labeled until stocks are depleted. Dow AgroSciences will maintain current state registrations through 2009. After state registrations expire, existing inventory in the channel of trade may not be sold; however, products may continue to be used according to package labels.
