California Gov. Arnold Schwarzenegger has signed Assembly Bill 711, which authorizes the state?EUR??,,????'?????<????????????EUR??,,??s landscape contractors to install outdoor fireplaces and cooking centers. Specifically, the new rule lets contractors install gas appliances and electric ignition systems, parts that previously occupied a legal gray area. The California Landscape Contractors Association (CLCA) argued in support of the bill. The association argued that the construction of outdoor kitchens and freestanding outdoor fireplaces occupied an ambiguous area of the law. While an outdoor kitchen qualifies as a ?EUR??,,????'?????<????????system or facility?EUR??,,????'?????<???????? within the meaning of California Code of Regulations Section 832.27, CSLB staff has been reluctant to permit landscapecontractors to perform certain work, such as the installation of electrical or gas appliances, water supply and wastewater drainage systems, and roofing, that are increasingly demanded by homeowners. CLCA states that local building officials also found this area of law confusing with some refusing to let landscape contractors pull permits and others allowing it. The previous law may have required homeowners to sign multiple contracts for a landscape project with a kitchen or fireplace, thereby forcing the homeowner to become an ?EUR??,,????'?????<????????owner-builder?EUR??,,????'?????<???????? with additional exposure to liability should a worker be hurt on the job.
