Arizona contractors are challenging a federal court ruling that recently affirmed the state?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s controversial labor-enforcement law.
If enforcement starts on March 1, any Arizona employer could be prosecuted if a worker turns out to be undocumented.
The Arizona Landscape Contractors Association (ALCA) along with the Arizona Contractors Association and 10 other groups are paying for the legal challenge?EUR??,,????'?????<????????????????????which could determine if state-based workers enforcement spreads to other parts of the country.
The business groups have filed a ?EUR??,,????'?????<?????????????????motion for emergency stay?EUR??,,????'?????<????????????????? with the court that could result in a freeze on enforcement being issued over the next two weeks. If that fails, the legal appeal is likely to be heard over the next six to nine months. Without the stay, however, enforcement would begin on March 1.
?EUR??,,????'?????<?????????????????(Landscape contractors) should be worried in other states too, because portions of the Arizona law are being considered in other states,?EUR??,,????'?????<????????????????? ALCA spokesman Farrell Quinlan said. ?EUR??,,????'?????<?????????????????This is not a magic bullet for illegal immigration.?EUR??,,????'?????<?????????????????
Arizona?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s controversial law requires employers to run pre-employment checks on workers. If new workers are found to be undocumented, county prosecutors could file charges against a business. That?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s not fair, Quinlan said, because the federal government?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s E-Verify database only runs checks after workers are hired.
In issuing his ruling on Feb. 7, Judge Neil Wake wrote, ?EUR??,,????'?????<?????????????????the act contains provisions for weeding out frivolous complaints and provides enforcement officers with discretion.?EUR??,,????'?????<?????????????????
Other opponents of Arizona?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s law argue that matters relating to border enforcement should be left to federal agencies like Immigration and Customs Enforcement, or ICE.
?EUR??,,????'?????<?????????????????People feel that the federal government isn?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????t controlling the border, and they?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????re trying to fill the breach (with state laws),?EUR??,,????'?????<????????????????? Quinlan said.
Signed into law last year, The Legal Arizona Workers Act gives the state authority to suspend or revoke business licenses of employers found to have knowingly or intentionally hired an undocumented worker.
Since the federal judge?EUR??,,????'?????<???????????????????????(R)?EUR??,,????'????s ruling, several media reports have suggested that Arizona landscape businesses and workers may be moving from the state to avoid legal trouble. At least of portion of that discomfort may be due to a decline in construction related to the economy, however.
Still, landscaping professionals in the state are clearly worried about what the law means for their businesses.
