The American Nursery & Landscape Association (ANLA) has submitted official comments on the Department of Labor?EUR??,,????'?????<????????????EUR??,,??s (DOL) proposal to overhaul the H-2A agricultural temporary and seasonal guest worker program (some nurseries use H-2A workers).
ANLA opposes the proposal as making the already-cumbersome and unpopular H-2A program more burdensome, bureaucratic and unresponsive. H-2A provides only three percent of the hired farm labor force in the U.S.
In February 2008, the Bush Administration?EUR??,,????'?????<????????????EUR??,,??s DOL made broad changes to H-2A that took effect January 17, 2009. Farm worker advocates sued DOL, a suit still pending. In March, the Obama Administration?EUR??,,????'?????<????????????EUR??,,??s DOL proposed to suspend the rules, but the suspension was blocked by a federal district court in North Carolina, so DOL moved to rewrite the program.
The DOL?EUR??,,????'?????<????????????EUR??,,??s latest proposal reverses several program changes achieved by the Bush regulations that were seen as popular additions, such as simplified applications and a new wage structure. The new proposal has much stricter enforcement, debarment and penalties. ANLA believes only balanced legislative reforms to H-2A, such as those featured in the AgJOBS legislation, will provide a stable and predictable program. ANLA is urging DOL not to rewrite H-2A rules.
